INFORMATION ON THE PROCESSING OF PERSONAL DATA

pursuant to art. 13 of the Regulation (EU) 2016/679 “GDPR” and any other applicable laws (collectively the “Privacy Laws”)

Giorgio Armani S.p.A., the Giorgio Armani local Companies, as identified below (also collectively “Giorgio Armani”) and other Companies of the Armani Group, indicated in the table below, acting as data controllers, inform you about the processing of your personal information (“personal data”) pursuant to the applicable Privacy Laws.

1. Source of personal data

Giorgio Armani collects and processes the personal data you provide to us when you register as a customer on our CRM (such as your name, surname, address, date of birth, nationality, email), the data you provide to us during the events organized by Giorgio Armani or which Giorgio Armani takes part in and the data we collect during your interaction with Giorgio Armani, including details of purchases and the shops where they were made. Personal data may be collected from you when you make purchases and during other interactions you have with Giorgio Armani, regardless of whether such activities take place in stores or online. This may include personal data collected during your interaction with our websites and our Internet and mobile applications (sites/Apps subscription and participation in online initiatives such as newsletters, contests and promotions) and in connection with the provision, by Giorgio Armani, on request by you, of information/materials. In accordance with the applicable Privacy Laws, the personal data we collect about you from time to time will be used to update and modify information previously collected, to ensure that the personal data we hold about you is accurate, up-to-date and complete.

Giorgio Armani does not process any special categories of data such as data related to health, religious or philosophical beliefs, political opinions.

2. Processing purposes and legal bases

We process your personal data for the following purposes.

a) Purposes necessary for the management of the customer relationship

Giorgio Armani local Company, acting as data controller for this purpose, processes your personal data in order to manage the sale of Giorgio Armani products and services and related after-sales services (e.g. changes, returns and warranties), your registration with our CRM, your registration and interaction with our websites and Apps, whose Privacy Policy and applicable Cookie Policy you may consult, and to respond to your requests for information and/or materials.

Giorgio Armani local Company also processes your personal data in order to comply with contractual obligations for the provision of goods and services, related legal and regulatory obligations (including anti- fraud and anti-money laundering activities) and in connection with any court or regulatory proceedings. For the above mentioned purposes, Giorgio Armani processes personal data such as your email, name, surname, country, address, telephone number, information on Giorgio Armani products purchased from our retail stores or online and your interaction with the Giorgio Armani world (e.g. visits to stores, participation in events, use of our websites and our Apps).

b) Additional purposes

With your consent, which is optional, Giorgio Armani S.p.A., acting as data controller for this purpose, intends to use your personal data (including, for example, your name, surname, date of birth, contact details, address, country) for the purpose of marketing fashion-related products, services and initiatives, i.e. to send you promotional newsletters, commercial or advertising communications, for direct sales, market research, statistical analyses, surveys to measure the degree of satisfaction of customer and potential customer. Marketing activities are carried out by e-mail (newsletter), telephone, SMS/MMS, chat, social networks and traditional mail, including the dispatch of invitations to events to which Giorgio Armani participates or organized by Giorgio Armani. These communications also include offers on fashion, sports and food & beverage related products, services and initiatives of other companies of the Armani Group; in this case we do not share your data with other companies of our Group but we provide you with commercial information on products, initiatives and services of such companies. You may at any time indicate your preferred method of contact among those listed above and may object to the receipt of promotional communications through all or only some of the channels of communication listed above. Your consent is required in order for us to use your personal data for marketing purposes.

With your consent, which is optional, Giorgio Armani S.p.A., acting as data controller for this purpose, gathers information, at Giorgio Armani stores and online through Giorgio Armani’s websites and Apps, about your preferences, habits, lifestyle, information about your interaction with Giorgio Armani, as well as details of purchases made in order to use them for the creation of individual and group profiles (“profiling”) and the dispatch of communications and personalized promotional offers for fashion-related products, services and initiatives.

The following information is also used for profiling activities: information obtained by comparing data we collect with data that is generally available to the public, such as social network profiles you made public; information collected through cookies and other tracking technologies on our websites, Apps and newsletters (please see the applicable Cookie Policy published on our websites and Apps) - including for example the ability to check whether you have read our newsletter or whether you have selected elements in our newsletter. We use this information in order to understand whether you are a customer who is still interested in the Giorgio Armani world or not - please, see the section on data retention below.

Personalized marketing activities are carried out by e-mail (newsletter), telephone, SMS/MMS, chat, social networks and traditional mail, including the dispatch of invitations to events. You may at any time indicate your preferred method of contact among those listed above and may object to the receipt of promotional communications through all or only some of the channels of communication listed above.

With your consent, which is optional, Giorgio Armani S.p.A., acting as data controller for this purpose, intends to process your data (including, for example, your name, surname, date of birth, contact details, address, country) in order to share it with other companies of the Armani Group, such as our basketball company or our food & beverage companies, for the purpose of marketing fashion, sports and food & beverage related products, services and initiatives as indicated above, through e-mail (newsletter), telephone, SMS/MMS, chat, social networks and traditional mail. You may at any time indicate your preferred method of contact among those listed above and may object to the receipt of promotional communications through all or only some of the channels of communication listed above. Your written consent is required in order for us to share your personal data for marketing purposes.

For Australia: If your personal data is shared with other companies in the Armani Group (table below) pursuant to this paragraph, it will be collected and used by such companies only for the purpose described in this paragraph and will be held by such companies in accordance with this notice.

To verify or change your preferences, you may contact Giorgio Armani or Giorgio Armani’s Data Protection Officer at any time at the addresses indicated below or, if this feature is available, you may access your profile page on our websites and Apps.

3. Methods of processing

Giorgio Armani collects and processes your personal data with and without the use of electronic means, according to logics and procedures consistent with the purposes indicated above and in compliance with the applicable Privacy Laws, including confidentiality and security requirements.

The types of activities that we undertake for such purposes include data collection, registration, organization, storage, consultation, processing, modification, selection, mining, comparison, use, interconnection, blocking, communication, cancellation and erasure operations.

4. Data Retention

Your personal data is stored and retained by Giorgio Armani strictly for so long as necessary to achieve the processing purposes for which it was collected and to comply with obligations under applicable laws and regulations. For those activities which are necessary to perform the contract for the provision of our goods and services, data is stored for administrative and accounting purposes for ten years after the conclusion of the contract, or as otherwise required by applicable Privacy Laws. Longer-term storage is permitted if authorized by law and to defend rights in court.

For profiling and customized marketing purposes, data is stored for a 7-year period, following the privacy impact assessment carried out by Giorgio Armani with the participation of Giorgio Armani Data Protection Officer, in compliance with applicable Privacy Laws.

For general marketing activities, data is stored until your request of erasure, withdrawal of consent or objection to processing. Your personal data is erased after 4 years in case you no longer interact with Giorgio Armani in any way (i.e. through purchases at our retail stores or online, visits to stores, participation in events, use of our sites and Apps, interaction with our newsletters), in compliance with applicable Privacy Laws. We remind you that you may at any time withdraw your consent as well as request the erasure of your data for marketing and profiling purposes and object to the processing of your data for marketing purposes. At the end of the above mentioned periods, data is automatically erased or anonymized in a permanent and non-reversible way, unless Giorgio Armani is required to store data for a further period to comply with obligations under applicable laws and regulations.

5. Nature of providing data and consequences of not providing data

For the purposes referred to in section 2. a) above, providing your data to Giorgio Armani local Company is necessary, and refusal to provide relevant personal information for such purposes would prevent the performance of the activities referred to in section 2. a), such as providing you with the products and services requested and replying to your requests for information and materials.

For the purposes referred to in section 2. b) above, providing your data to Giorgio Armani S.p.A. is optional and refusal thereof will have no effect on the ability to purchase Giorgio Armani products and services and receive the information and materials requested.

For Australia and Canada: For the purposes referred to in section 2. b) above, providing your data to Giorgio Armani S.p.A. or any other Armani Group companies is optional and refusal thereof will have no effect on your ability to purchase Giorgio Armani products and services and receive the information and materials requested.

6. Categories of subjects with whom we may share your data

Personal data is accessible to our duly authorized staff (e.g. staff of the Ecommerce, CRM, Customer Service, IT functions) according to necessity, in their capacity of persons authorized to process personal data and/or internal data processors and/or system administrators. Your personal data is also shared with our service providers, e.g. for services of technical and organizational nature, which provide support to Giorgio Armani’s business functions when carrying out the purposes described above, such as independent collaborators, also in associated form, shipping, marketing, payment management companies, which may be located within and outside of your jurisdiction. We only provide them with the data necessary to perform the agreed services and they act as our Data Processors on the basis of our instructions.

In addition, for marketing activities, including customized marketing, and to ensure you the same benefits worldwide, other companies of the Armani Group worldwide may access your personal data acting as our Data Processors, based on the instructions we give them.

For Australia and Canada: In addition, for marketing activities, including customized marketing, and to ensure you the same benefits worldwide, other companies of the Armani Group may access your personal data, acting as our Data Processors, if you have given your consent as set out in section 2 of this notice, but only based on the instructions we give them.

Finally, if you provide consent, Giorgio Armani may share data with other Companies of the Armani Group worldwide, for their own marketing purposes. The list of the Companies of the Armani Group, and their respective jurisdiction, is available at the table below.

Your personal data is shared with third parties in the following cases: (i) when the communication is required by applicable laws and regulations with respect to legitimate third parties, such as authorities and public bodies, which act as independent data controllers for their respective institutional purposes; (ii) communications to third parties (such as an actual or proposed assignee, transferee, participant or sub- participant of our rights or business) who act as independent data controllers, in case of extraordinary operations (e.g. mergers, acquisitions, transfer of business, etc.). Your personal data will not be disseminated, except in the case of specific initiatives (e.g. online), in respect of which we will provide you with detailed information when such initiatives take place.

Some of the companies of the Armani Group and some of our service providers, which may have access to your personal data, may be established abroad, in third countries. Giorgio Armani is therefore likely to disclose your personal information to overseas recipients. This may include recipients in countries that do not provide the same or an equivalent level of data protection, in accordance with the standards set forth under applicable Privacy Laws. Giorgio Armani implements the necessary safeguards by way of contractual or other means, for a legitimate transfer of data and to ensure a comparable level of protection for the personal data transferred abroad. We are likely to disclose data to such countries. You may request information on the transfer of your personal data abroad at any time by contacting Giorgio Armani or Giorgio Armani Data Protection Officer at the addresses indicated below.

7. Data subject’s rights

For Australia: Our Privacy Policy, available at the stores contains information about how you may complain about a breach of the Australian Privacy Principles and how we will deal with such a complaint. Our Privacy Policy also contains information about how you may access your personal information held by Giorgio Armani and seek correction of such information.

You may contact Giorgio Armani in its capacity as data controller at any time, or the Data Protection Officer of the Armani Group, at the addresses indicated below in order to obtain an updated list of our data processors (i.e. our service providers) and of the subjects with whom we may share your personal data, and to exercise at any time the rights granted to you under the applicable Privacy Laws, such as: obtain confirmation as to whether or not your data exists, access your data, verify its content, origin, accuracy, request its integration, updating, rectification, erasure, anonymization, request data portability, restriction of processing, and you may lodge a complaint to the competent authority (for the EU: the list of the Supervisory Authorities according to GDPR is available in the “List of the European Supervisory Authorities” below; for Switzerland: the relevant authority would be a civil court). In addition, you may withdraw your consent at any time to the processing of your personal data, object to direct marketing activities and, where applicable, you may object to the processing of your personal data processed on the basis of Giorgio Armani legitimate interest unless it is shown that there are overriding legitimate reasons for the processing by Giorgio Armani (e.g. the exercise or defense of a right in court).

For Mexico: If you decide to exercise your ARCO Rights, our DPO will inform you of the following: (i) the information you need to provide for purposes of demonstrating your identity or your representative’s legal personality to act on your behalf and the information or documentation that should accompany the application; (ii) the time that we will take to respond to your request; (iii) the way you must submit your application, including the template, if any available; and (iv) the mode or means of reproduction we will use to provide you with the requested information (which will generally be simple copies or electronic documents).
